1. General

These General Terms and Conditions include the rights and obligations relating to the services and information provided by CK FOOD SUPPLIERS (with registered office at Zevenkaven 13, B-8560 Wevelgem, registered in the Crossroads Bank for Enterprises under number 0770.700.929; hereinafter: “Yum- it”) via its website which is accessible via yum-it.eu (hereinafter: “the Website”). In particular, they include the rights and obligations of Yum-it and the rightful user(s) with regard to the information and services offered and/or processed by Yum-it directly or indirectly via the Website.

2. Object and Objective

The general objective of the Website is to provide general and specific information about the products, services and activities of Yum-it, including news facts, events and projects that are (co-)organized by the latter or in which it is involved. The Website does not contain any binding statements for Yum-it on which the User(s) can rely.

Through the Website, Yum-it also processes and provides (relevant) information relating to its Users, which information has either been collected by Yum-it itself in the context of its activities, or by the Users directly to Yum-it or indirectly via public channels, such as social media.

5. Admission requirements

The User gains access to and can use these services if it meets the admission conditions for the relevant services, systems, applications and/or data. Yum-it may at any time autonomously and at its own discretion check and decide whether a User meets these admission conditions, and suspend or discontinue all or part of the products or services provided by Yum-it if this is no longer the case, without the User being entitled to can make on any form of (damage) compensation or refund from Yum-it.

6. Nature of the commitments

The nature of the obligations relating to the services provided by Yum-it to the User concern, unless expressly agreed otherwise, obligations of means. When providing the services, Yum-it will always apply the current professional standards, taking into account the state of the art. To the extent that a separate written agreement has been concluded between the parties, the minimum levels of service agreed therein (in terms of quality and/or quantity) contain obligations of result, which take precedence over these general terms and conditions.

Considering that the availability and correct functioning of the systems and applications made available to the User by Yum-it under this agreement may depend on the availability of third party systems, applications and data with which Yum-it has not concluded an agreement, it therefore gives no guarantee whatsoever with regard to whether or not all its systems, applications and/or data are accessible on a continuous or even temporary basis.

7. Liability

In view of the above, Yum-it cannot be held liable for the unavailability of the Website, or for incomplete or incorrect information, with the exception of fraud and/or deceit on the part of Yum-it that can be directly attributed to the latter.

8. Subcontracting

Yum-it is permitted to outsource the delivery of its products or services in whole or in part to a third party, without the consent of the User being required. The parties expressly agree that such agreement(s), except for the express written agreement of Yum-it, do not create any commitment or obligation towards the Customer. Yum-it expressly accepts to be and to remain liable for the services it has outsourced to one or more subcontractors, unless otherwise agreed in writing.

9. Applicable law; Courts

These general terms and conditions are exclusively governed by Belgian law. In the event of a dispute between the parties relating to the information made available by Yum-it via the Website, only the courts mentioned in the invoice conditions will be competent to hear such a dispute, whereby the parties will, however, make the necessary efforts. to reach an amicable settlement in advance.
